4.1 Pre-Owned Golf Equipment

ReGolf specializes in pre-owned golf equipment. All Products arecarefully inspected and graded based on condition. Productdescriptions, photographs, and condition ratings are provided forinformational purposes and represent our best assessment at thetime of listing.

4.2 Product Descriptions and Accuracy

We strive to provide accurate descriptions, specifications, and imagesof all Products. However:

Colors, images, and product details may vary slightly fromactual Products due to screen settings, lighting, and photography

Pre-owned Products may show normal signs of wear consistentwith their condition rating

We do not warrant that product descriptions or other contentare error-free, complete, or current

4.3 Inventory and Availability

Product availability is subject to change without notice. Due to theunique nature of pre-owned inventory:

Products are sold on a first-come, first-served basis

Inventory listed online may not be available in-store and viceversa

We reserve the right to limit quantities or discontinue anyProduct at any time

If a Product becomes unavailable after you place an Order, wewill notify you and issue a full refund

4.4 Pricing

All prices are listed in Canadian Dollars (CAD) and include applicabletaxes unless otherwise stated. We reserve the right to:

Change prices at any time without prior notice

Correct pricing errors on our Website or in promotionalmaterials

Cancel or refuse Orders placed at incorrect prices due totechnical or human error

If a pricing error occurs after you place an Order, we will notify youand provide the option to complete the purchase at the correct priceor cancel the Order for a full refund.

All online payments are processed securely through ShopifyPayments. We do not store complete credit card information on ourservers. By providing payment information, you:

6. Shipping and Delivery (Online Orders)

6.1 Shipping Methods and Costs

We offer shipping within Canada. Shipping costs are calculated atcheckout based on:

Shipping fees are non-refundable unless we make an error infulfilling your Order.

6.2 Delivery Timeframes

Estimated delivery times are provided at checkout and are based onbusiness days (Monday to Friday, excluding holidays). Delivery timesare estimates only and are not guaranteed. We are not responsiblefor delays caused by:

Weather conditions

Customs clearance (if applicable)

Incorrect or incomplete delivery addresses provided by you

6.3 Shipping Address

You are responsible for providing an accurate and complete shippingaddress. We are not liable for Orders delivered to incorrect addressesprovided by you. If a package is returned to us due to an incorrectaddress, we will contact you to arrange reshipment at your expense.

6.4 Risk of Loss

Title and risk of loss for Products purchased online pass to you upondelivery to the shipping carrier. If a package is lost or damaged duringshipping, please contact us immediately at info@regolfco.com, and wewill work with the carrier to resolve the issue.

6.5 International Shipping

At this time, we only ship within Canada. We do not offerinternational shipping.

7. Returns, Refunds, and Exchanges

7.1 Return Policy Overview

We want you to shop with confidence. If you are not satisfied withyour purchase, you may return eligible Products within 30 daysof the purchase date, subject to the conditions outlined below.

Returns are accepted for both online and in-store purchases.

7.2 Eligibility for Returns

To be eligible for a return, Products must:

Be returned within 30 days of the original purchase date

Be in the same condition as when received (unused, undamaged,with original tags if applicable)

Include proof of purchase (order confirmation email, receipt, ororder number)

Non-returnable Products:

Products marked "as-is" or "final sale" at the time of purchase

Products that have been altered, customized, or damaged afterpurchase

7.3 Return Process

For Online Orders:

Provide your order number and reason for return

We will provide return instructions and a return authorization(if applicable)

Ship the Product back to us using a trackable shipping method(you are responsible for return shipping costs unless the returnis due to our error)

Once we receive and inspect the returned Product, we willprocess your refund or exchange

7.4 Refunds

Refunds will be issued to the original payment method within 10business daysof receiving and inspecting the returned Product.

Refund Details:

We will refund the purchase price of the Product

Original shipping fees are non-refundable (unless the return isdue to our error)

Return shipping costs are the customer's responsibility (unlessthe return is due to our error)

If you do not receive your refund within 10 business days of usreceiving the returned Product, please contact us atinfo@regolfco.com.

7.5 Exchanges

We offer exchanges for the same or different Products of equal orgreater value. If the replacement Product is of greater value, you will be responsible for the price difference. If the replacement Product isof lesser value, we will issue a refund for the difference or providestore credit at your discretion.

7.6 Store Credit

At our discretion, we may offer store credit in lieu of a refund. Storecredit:

Is valid for one year from the date of issuance

Can be used for in-store or online purchases

Is non-transferable and cannot be redeemed for cash

7.7 Damaged or Defective Products

If you receive a Product that is damaged, defective, or not asdescribed, please contact us immediately at info@regolfco.com or(604) 282-1168. We will arrange for a replacement or full refund,including shipping costs, at no additional cost to you.

To expedite the process, please provide:

Photos of the damaged or defective Product

A description of the issue

7.8 Restocking Fees

We do not charge restocking fees for eligible returns.

8. Trade-Ins

8.1 Trade-In Program

ReGolf offers a trade-in program for used golf equipment. Trade-invalues are assessed in-store based on:

Brand and model

Current market demand

Our inventory needs

8.2 Trade-In Terms

Trade-in values are provided as estimates and may change uponin-person inspection

Trade-in credit is issued as store credit and can be usedimmediately for purchases

Trade-in credit is non-transferable and cannot be redeemed forcash

We reserve the right to refuse any trade-in at our sole discretion

Once a trade-in is accepted and credit is issued, the transaction isfinal and cannot be reversed

9. Warranty and Disclaimers

9.1 Limited Warranty on Pre-Owned Products

ReGolf provides a 30-day limited warrantyon pre-owned golf clubspurchased from us. This warranty covers defects in materials andworkmanship that were not disclosed at the time of sale.

Warranty Coverage:

Structural defects (cracked clubheads, broken shafts, separatedferrules)

Manufacturing defects not consistent with normal wear

Warranty Exclusions:

Normal wear and tear (grip wear, cosmetic scratches, paintchips)

Damage caused by misuse, abuse, or improper care

Products sold "as-is" or marked "final sale"

Products altered or repaired by third parties after purchase

Warranty Process:

We will assess the issue and, if covered, provide a replacement,repair, or refund at our discretion

9.2 "As-Is" Products

Some Products may be sold "as-is" with specific condition disclosures.These Products are sold without warranty and are not eligible forreturn or exchange except as required by law.

9.3 No Extended Warranties

We do not offer extended warranties beyond the 30-day limitedwarranty. Any manufacturer warranties (if applicable to new orunused Products) are subject to the manufacturer's terms.

9.4 Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL PRODUCTSARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUTWARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, EXCEPT ASSPECIFICALLY STATED IN SECTION 9.1.

WE DISCLAIM ALL OTHER WARRANTIES, INCLUDING BUT NOTLIMITED TO:

Accuracy, reliability, or completeness of product descriptions

Uninterrupted or error-free operation of our Website

Pre-owned Products may have imperfections consistent with theirage and prior use. Condition ratings and descriptions are provided forinformational purposes but do not constitute a warranty.

10. Limitation of Liability

10.1 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REGOLF CO., ITSDIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATESSHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitivedamages

Loss of profits, revenue, data, or business opportunities

Personal injury or property damage arising from your use ofProducts (except where caused by our negligence or breach ofstatutory obligations)

Damages arising from unauthorized access to or alteration ofyour data or transmissions

Damages arising from third-party conduct, including shippingcarriers, payment processors, or other service providers

10.2 Cap on Liability

Our total liability to you for any claim arising from your use of our Services or purchase of Products shall not exceed the amountyou paid for the Product(s) giving rise to the claim, or $100 CAD,whichever is greater.

10.3 Exceptions

Nothing in these Terms excludes or limits our liability for:

Death or personal injury caused by our negligence

Fraud or fraudulent misrepresentation

Breach of statutory obligations that cannot be excluded orlimited by law

10.4 Basis of the Bargain

You acknowledge that the limitations of liability set forth in thisSection reflect a reasonable allocation of risk and are fundamentalelements of the bargain between you and ReGolf. We would notprovide the Services or sell Products without these limitations.

11. Indemnification

You agree to indemnify, defend, and hold harmless ReGolf Co., itsdirectors, officers, employees, agents, and affiliates from and againstany claims, liabilities, damages, losses, costs, or expenses (includingreasonable legal fees) arising from:

Your use of our Services or Products

Your violation of any third-party rights, including intellectualproperty rights

Your fraudulent or illegal conduct

We grant you a limited, non-exclusive, non-transferable, revocablelicense to access and use our Website and Content for personal, non-commercial purposes. You may not:

You represent and warrant that:

You own or have the necessary rights to the content you submit

Your content does not infringe on the intellectual property orprivacy rights of any third party

You consent to the use of your likeness, name, and content asdescribed above

13. Prohibited Conduct

You agree not to:

Use our Services for any illegal or unauthorized purpose

Violate any applicable laws, regulations, or these Terms

Impersonate any person or entity or misrepresent youraffiliation with any person or entity

Interfere with or disrupt the operation of our Website or servers

17.4 Waiver of Class Actions

You agree that any dispute resolution proceedings will be conductedon an individual basis and not as part of a class, consolidated, orrepresentative action. You waive any right to participate in a classaction lawsuit or class-wide arbitration.

18. Severability

If any provision of these Terms is found to be invalid, illegal, orunenforceable by a court of competent jurisdiction, the remainingprovisions shall remain in full force and effect. The invalid provisionshall be modified to the minimum extent necessary to make it validand enforceable, or if that is not possible, it shall be severed fromthese Terms.

Our failure to enforce any provision of these Terms or to exercise anyright or remedy shall not constitute a waiver of that provision, right,or remedy. Any waiver must be in writing and signed by ReGolf to beeffective.

These Terms, together with our Privacy Policy and any other policiesreferenced herein, constitute the entire agreement between you andReGolf Co. regarding your use of our Services and supersede all prioror contemporaneous agreements, communications, andunderstandings, whether oral or written.

21. Force Majeure

We shall not be liable for any failure or delay in performing ourobligations under these Terms due to circumstances beyond ourreasonable control, including but not limited to:

Acts of God (natural disasters, floods, earthquakes, fires)

War, terrorism, civil unrest, or government actions
Pandemics or public health emergencies
Labor strikes or disruptions
Failures of third-party service providers, internet infrastructure,or utilities

Our performance obligations will be suspended during the period of the force majeure event, and we will have no liability for any delay orfailure resulting from such events.
